Gym Rental

The McCutchanville Fire Department is proud to rent our facility to the public for a variety of different events. The gym was added to the McCutchanville School #3 in 1950 just prior to the school closing. The gym has had further renovation work completed in the past few years to allow for the best experience. Included in our facility is a medium-sized gym which can be used to play basketball games or host a large event. There is a stage which can be used for presentations or plays. Additionally, we have tables and chairs available for use. Both men and women’s restrooms have been renovated and are available inside the building.

The tables and chairs are located under the stage on rollers. Multiple trash cans are available in the gym and all trash is to be disposed of at the end of rental into the dumpster located on the south side of the building through the old kitchen. The gym is also expected to be left in the condition in which it was found to ensure the best experience for all parties that will be renting the facility.

The gym availability is displayed on the adjacent calendar. Click the date that you wish to book and then enter the start and end time in the selection fields below that. If you wish to book separate time slots you will need to submit a new form for each slot.

The cost to rent the gym is $50 per hour. Online payment is required to complete the booking process. If you fail to complete the payment portion of the booking, the booking will not be valid.

All rentals should include time for set-up and clean-up. Please take time to review the rental agreement before booking and accept the agreement when completing the booking process.

All sales are FINAL at submission of online rental.

This agreement is made on this date by and between the McCutchanville Volunteer Fire Department, Inc (hereafter “MVFD”) and the booking contact above (hereafter Renter). By its signature below, the Renter agrees to the following terms and conditions:

  1. The Renter desires to temporarily rent, occupy, and make use of the MVFD’s gymnasium (hereafter “Gym”) located at 9219 Petersburg Rd, Evansville, Indiana, 47725 (hereafter “Premises”). The Premises are owned by the Trustee of Center Township (hereafter “Trustee”). The rental includes restroom facilities and use of table and chairs upon request but does not include use of other sections of the building, grounds, amenities or the Premises (other than parking).
  2. The Renter shall have access to and have use of the Gym for the time scheduled and rental fees paid for the intended purpose (hereafter “Event”). MVFD shall provide to Renter all keys, access control codes, and other items necessary to give Renter access to the Gym. Rental shall begin at the scheduled start time and end at the scheduled finish time. Scheduled time rented includes any setup and cleanup needed for the Event.
  3. The Renter shall pay to the MVFD a rental fee of $50/hour to be collected after execution of this Agreement but before the Renter’s Event.
  4. The MVFD reserves the right to cancel this Agreement at any time if the cancellation is in the best interest of the MVFD. In the event that the MVFD cancels this Agreement, all rental fees paid will be refunded.
  5. The Renter is responsible for ensuring that the Gym is clean and in good repair at the end of the rental period and agrees to clean up any spills and/or debris, and to remove all personal property, trash, and other items that were not present in the Gym when Renter took control of it so that the Gym is returned to the MVFD in its original state. Cleaning supplies and trash bags are located in the Men’s Restroom storage cabinet as you enter the Gym. Renter agrees to pay MVFD any additional charges due to facility damage or necessity of repair/extensive cleaning caused by the Renter, and the Renter will be charged accordingly for such replacement and repair and shall pay all such amounts owed within 30 days of the receipt of any invoice from the MVFD; provided, however, the minimum cleaning fee to be charged by the MVFD shall be $100 per Event. The decision to repair or replace equipment shall be at the sole discretion of MVFD.
  6. The Renter shall assume all risks instant to or in connection with the Event and shall be solely responsible for all accidents or injuries whatsoever of any nature or kind to persons or property caused by its use of these premises. The Renter further agrees to waive and release the MVFD and the Trustee, jointly and severally, from any and all losses, claims, suits, judgments or damages that Renter might sustain as a result of any and all activities connection with the Event or associated with this Agreement. The Renter further agrees to indemnify the MVFD and the Trustee, jointly and severally, and save them harmless from any and all claims or liability for personal injuries or other damages to any person, including injuries resulting in the death of any person which injury or death is occasioned by or in connection with the use of the Gym. The Renter further assumes full responsibility for the character, acts and conduct of all persons admited to said Gym by the consent of the Renter. In renting the premises, MVFD does not relinquish the right to control the management thereof, and to enforce all necessary and property rules for management and operation of the same, and MVFD, through its director, policemen, firemen and other designated representatives, shall have the right at any time to enter any portion of said premises for any purpose whatsoever.
  7. The Renter shall use the gym in a safe and careful manner, and shall comply with all applicable local, State, and Federal Laws, and rules and regulations as prescribed by the Fire and Police departments. The Renter shall not in any way, mar, deface, alter or damage any part of the Gym. The Renter agrees to be responsible for any actions of its guests/invitees. All portions of the sidewalks, entries, passages, vestibules, halls, doors and all ways of access to the Gym and into any place on the premises shall in no way be obstructed by the Renter.
  8. The Renter understands that no alcohol, illegal drugs, smoking, vaping, chewing tobacco, weapons or firearms are allowed on the Premises. Any violation will result in the loss of rental fees and the immediate removal of Renter and its associates, guests, invitees, contractors and all other persons whatsoever who enter the Gym and/or Premises during the rental period - even if the Renter did not have any actual knowledge of the violation.
  9. No pets are allowed. Service animals may be denied access to the Gym if there is a threat to the health or safety of others.
  10. Use of the Gym shall be restricted to the Renter and its invited guests. The Renter shall not sublease or assign use of the Gym or Premises without the prior writen consent of the MVFD, which consent may be unreasonably withheld.
  11. Any disputes arising under this Agreement shall be adjudicated in Vanderburgh County, State of Indiana. Renter shall also be liable to the MVFD for all reasonable atorney’s fees, court costs, and other expenses associated with any disputes.
  12. No delay or omission of the exercise of any right of the MVFD, or any waiver of any breach or violation of the Renter by the MVFD under this Agreement, shall be construed as a continuing waiver or consent to any subsequent breach or violation.
  13. This Agreement shall constitute the entire Agreement between the parties. Any prior understanding or representation of any kind preceding the date of this Agreement shall not be binding upon either party except to the extent incorporated in this Agreement.
  14. Any modification to this Agreement or additional obligation assumed by either party in connection with this Agreement shall be binding only if evidenced in writing signed by the Renter and approved by the MVFD.
  15. Any provision or part of this Agreement held to be void or unenforceable under any law or regulation shall be deemed stricken and all remaining provisions shall continue to be valid and binding upon the MVFD and the Renter, who agree that the Agreement shall be reformed to replace such stricken provision or part thereof with a valid and enforceable provision that comes as close as possible to expressing the intention of the stricken provision.
  16. This Agreement shall be governed by and construed in accordance with the laws of the State of Indiana. In the event of any legal action under this Agreement, venue shall be in Vanderburgh County, State of Indiana. MVFD and RENTER HEREBY WAIVE ANY RIGHT TO A TRIAL BY JURY SHOULD ANY ACTION BE FILED.
  17. It is specifically declared that time is of the essence in all provisions of this Agreement.
  18. The titles to the articles, sections or paragraphs of this Agreement are solely for the convenience of the parties and shall not be used to explain, modify, simplify, or aid in the interpretation of the provisions of this Agreement.
